Terms of Service

The agreement between you and Witty Technologies for using Witty Notify.

1. Acceptance of these terms

By creating an account or using Witty Notify, you agree to these Terms of Service and our Privacy Policy. If you're using Witty Notify on behalf of a business, you confirm you have authority to bind that business to these terms.

2. What the service is

Witty Notify bridges your email inbox into WhatsApp — inbound emails become WhatsApp notifications, and replies you send from WhatsApp go out as real emails. See how it works for the technical detail. We rely on third-party services (notably Meta's WhatsApp Business Cloud API and PayFast) to deliver parts of the service, and availability of those third parties isn't within our control.

3. Your account

You're responsible for keeping your password and API keys confidential, and for all activity under your account. Tell us immediately if you suspect unauthorised access. You must provide accurate registration information and keep it up to date.

4. Acceptable use

You agree not to use Witty Notify to:

• Send unsolicited, spam, or bulk messages to recipients who haven't consented to hear from you.
• Violate WhatsApp's Business Policy or any Meta platform terms — a template or account suspended by Meta for policy violations can't be restored by us.
• Transmit unlawful, fraudulent, defamatory, or harmful content.
• Attempt to interfere with, reverse-engineer, or overload the service or its infrastructure.
• Use the service to violate anyone else's privacy or legal rights.

If you register a WhatsApp message template (for messaging people who haven't messaged you first), you're responsible for having a lawful basis and appropriate consent to contact those recipients. Every Witty Notify customer shares one underlying Meta Business Account — a policy-violating or spam-flagged template puts every customer's service at risk, not just yours, so we reserve the right to reject, suspend, or remove templates and accounts that put the shared account's standing with Meta at risk.

5. Plans, credits, and billing

Paid plans renew automatically each month via PayFast until you cancel from your Billing page. Cancelling stops future renewals; you keep access to what you've already paid for until the end of the current billing period is not currently automated, so cancellation takes effect at the point you cancel, not at period end. Purchased message credits are non-refundable and have no cash value, except where required by law. Prices are in South African Rand and may change with notice on this site.

6. Refunds

Subscription charges and credit purchases are generally non-refundable once processed. If you believe you were charged in error, contact us at connect@wittytechnologies.com and we'll look into it in good faith.

7. Service availability

We aim for reliable service but don't guarantee uninterrupted availability. The service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, Witty Technologies isn't liable for indirect, incidental, or consequential damages arising from your use of the service, including lost business, lost messages, or lost data, beyond amounts you've paid us in the preceding three months. Nothing here limits liability that can't be limited under South African law.

9. Termination

You may stop using Witty Notify and delete your account at any time from your profile — this permanently erases your data (see Privacy Policy). We may suspend or terminate accounts that violate these terms, in particular the acceptable-use and WhatsApp policy requirements above, with notice where reasonably possible.

10. Intellectual property

The Witty Notify platform, its code, and branding are the property of Witty Technologies. Your account gives you a licence to use the service — it doesn't transfer ownership of the platform to you. If you're interested in acquiring the platform itself, see Acquire this platform.

11. Governing law

These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of South African courts.

12. Changes to these terms

We may update these terms from time to time; the date at the top of this page reflects the latest version. Continuing to use the service after a change means you accept the updated terms.
